These Terms & Conditions (“Terms”) apply to your use of our website (www.edengreenhouses.co.nz) and any purchase of products from Eden Greenhouses (“Eden”, “we”, “us”, “our”). By using our website or placing an order, you agree to these Terms. If you do not accept them, please do not use our website or purchase our products.

1. Application of Terms

1.1 These Terms govern your use of our website and any purchase of products.
1.2 By using our website or placing an order, you confirm that you accept these Terms and, if acting on behalf of an entity, that you have authority to bind that entity.
1.3 We may update these Terms from time to time. If we make significant changes, we will notify users via our website or by email. Continued use after updates indicates acceptance.

2. Consumer Guarantees Act (CGA)

The Consumer Guarantees Act 1993 (CGA) is a New Zealand law that protects consumer rights when goods or services are acquired for personal use.

3. Prices, Payments & Orders

3.1 All prices are in New Zealand Dollars (NZD) and include GST unless otherwise specified.
3.2 Payment methods accepted include direct bank transfer and credit card (Visa and Mastercard).
3.3 A 50% deposit is required to commence manufacturing. The remaining balance must be paid before dispatch, collection or installation.
3.4 If you cancel your order after manufacturing has commenced, the 50% deposit is non-refundable. This does not affect your rights under the Consumer Guarantees Act 1993.
3.5 For factory collection, please collect your order within 14 days of being notified that it is ready.
3.6 If items are unavailable, we will notify you and offer suitable alternatives or the option to cancel or defer your order.
3.7 A finance charge of 10% per annum applies to overdue accounts. This charge will be specified on your invoice. You will be responsible for all reasonable costs incurred in recovering overdue amounts.
3.8 An order is not accepted until confirmed by Eden Greenhouses. We reserve the right to decline or cancel an order before confirmation where a product is unavailable, a pricing error has occurred, or another error has affected the order. If payment has already been received, it will be refunded in full.

4. Shipping, Delivery & Installation

4.1 Shipping

Our separate Shipping Policy sets out the full details on delivery, shipping methods, freight arrangements and related information. This policy forms part of these Terms & Conditions.


Please inspect your products and all packaging as soon as possible after delivery and notify us if you believe they are faulty, damaged or incomplete.

 

4.2 Third-Party Delivery & Installation

  • Eden Greenhouses may use approved third-party freight providers for delivery and, where applicable, approved installers for installation. Where these services are arranged by Eden Greenhouses, this does not limit our responsibilities under the CGA.
  • If you arrange your own freight, installer or contractor, Eden is not responsible for any loss, damage or installation issues arising from those services. Any damage caused during customer-arranged transport, handling or installation is not covered by our Warranty Policy.

This does not affect your rights under the Consumer Guarantees Act 1993.

5. Returns & Refunds

5.1 Change of Mind Returns

If you change your mind, we may accept a return at our discretion, subject to the following conditions:

  • Requests must be made within 30 days of delivery.
  • The item must be unused, in its original condition and packaging, free from scratches, dents, damage or modifications, and accompanied by proof of purchase.
  • Please inspect your order before requesting a return or refund. If the item is damaged or defective, refer to Section 5.3.
  • Return shipping and any associated freight costs are at your cost.
  • A 15% restocking fee applies.
  • Original shipping charges are non-refundable.

5.2 Non-Returnable Items

Change-of-mind returns are not available for greenhouses that have been powder coated or manufactured with customised features or specifications, unless faulty.


Clearance or factory second items are sold as-is and are non-returnable except as required under the CGA.

Installed structures are only returnable if covered under warranty for defects.

5.3 Faulty, Damaged or Not as Described Goods

Under the Consumer Guarantees Act, if your product is:

  • faulty;
  • damaged in transit; or
  • does not match its description or is not of acceptable quality,

you are entitled to a repair, replacement or refund.


Please contact us as soon as possible with photographs and a description of the issue. For structural concerns (for example, frame damage), we may arrange an onsite assessment.

If your claim is accepted, we will cover the cost of return shipping and also refund your original shipping fee where applicable.

If the product is found not to be faulty or has been damaged by misuse, improper installation or environmental factors, you may be responsible for return shipping or inspection costs.

We are not liable for any direct or indirect losses arising from delays in supplying replacement parts or arranging repairs, except where required under the Consumer Guarantees Act 1993.

5.4 Refunds

Approved refunds will be processed to your original payment method within 10 business days of us receiving and inspecting the returned item.

If you paid by credit card, please allow additional time for your bank to process the refund.

5.5 How to Make a Return or Claim

  • Contact us first — please do not send items back without authorisation.
  • Provide your sales order number, photographs (if applicable), and a description of the issue.
  • If your return is approved, Eden Greenhouses will arrange the return freight and provide you with the next steps.
  • Please do not arrange or send return freight yourself unless instructed by Eden Greenhouses.

5.6 Returns Contact Details

6. Warranty

Eden Greenhouses offers a 20-Year Structural Guarantee, with separate warranty periods applying to the aluminium framework, powder-coated finish, hardware, accessories and optional components.

This warranty does not replace or limit your rights under the Consumer Guarantees Act 1993. Full details are set out in our Warranty Policy.

7. User Obligations

7.1 Account Information

Ensure all information provided is accurate. Notify us immediately of any unauthorised use of your account.

7.2 Prohibited Conduct

Do not misuse our website (for example, by introducing malware, scraping, reverse-engineering code or circumventing security).

7.3 Product Orders

You are responsible for ensuring your site is suitable for installation and for obtaining any required council approvals or consents. This does not affect your rights under the Consumer Guarantees Act 1993 regarding product quality or fitness for purpose.

8. Intellectual Property

8.1 All intellectual property, including greenhouse designs, manuals, drawings and brand content, is owned by Eden Greenhouses or our licensors.
8.2 Materials are provided for your personal, non-commercial use.

9. Website & Product Information

9.1 Product Suitability & Compliance

Greenhouses must be installed in accordance with our guidelines. You are responsible for ensuring local council approvals and preparing your site. This does not affect your rights under the Consumer Guarantees Act 1993 regarding product quality or fitness for purpose.


9.2 Website Content

Product images are illustrative only. Actual colours, finishes and dimensions may vary slightly. We may link to third-party websites; these links do not imply endorsement, and we are not responsible for their content.


9.3 Website Errors

While we make every effort to ensure pricing and product information on our website is accurate, we reserve the right to correct any errors, omissions or inaccuracies and to cancel or amend orders affected by them. If this occurs, we will contact you as soon as reasonably practicable.


9.4 Environmental Conditions

Our greenhouses are designed for typical New Zealand conditions. However, extreme weather events may affect product performance and warranty coverage as outlined in our Warranty Policy.

10. Liability

10.1 Consumer Transactions

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.


10.2 Business Transactions:

If you are acquiring our products for business purposes subject to a Small Trade Contract, to the fullest extent permitted by law:
a) we exclude liability for indirect or consequential loss (such as lost profits); and
b) our liability for direct loss is capped at NZD $10,000. This limitation does not apply where the Consumer Guarantees Act 1993 applies.

11. Force Majeure

11.1 Eden Greenhouses shall not be liable for any loss, damage, delay in delivery or failure to perform any part of this contract where such delay or failure is caused by circumstances beyond our reasonable control.
11.2 These may include (but are not limited to) extreme weather events (such as floods, fires or earthquakes), pandemics, epidemics, armed conflict, labour strikes or disputes, civil unrest, government restrictions or actions, supply chain disruptions, shortages of labour or materials, transport interruptions or accidents.

12. Dispute Resolution & Governing Law

We aim to resolve complaints in good faith. If we cannot reach agreement, any disputes will be governed by the laws of New Zealand and subject to the exclusive jurisdiction of the New Zealand courts.
